These Terms & Conditions ("Terms") govern your access to and use of https://artletique.com (the "Website"), including any purchases made through the Website.

Throughout these Terms, "Vie Artlétique," "we," "our," and "us" refer to Vie Artlétique.

By accessing or using our Website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website. 1. Eligibility

You must be the greater of 18 years old or the age of majority in your jurisdiction, to make purchases through our Website. If you are under the age of majority, you may only use the Website with the involvement and consent of a parent or legal guardian.

You agree to use the Website only for lawful purposes and in accordance with these Terms.

2. Products

Vie Artlétique offers premium footwear, apparel, accessories, and related products.

We strive to ensure that all product descriptions, specifications, images, and pricing are accurate. However, colors and product appearance may vary depending on your device or display settings.

We reserve the right to discontinue products, modify product offerings, or limit product quantities at any time without notice.

3. Pricing

All prices displayed on the Website are shown in the applicable currency and are subject to change without notice.

Applicable taxes, shipping charges, duties, and other fees will be calculated at checkout where required. 

Although we make every effort to ensure pricing accuracy, we reserve the right to correct pricing errors and cancel orders affected by such errors.

4. Orders

Submitting an order does not constitute acceptance of that order.

Vie Artlétique reserves the right to:

• Accept or decline any order;
• Limit quantities purchased; 
• Refuse orders that appear to be placed by resellers or distributors;
• Cancel orders due to pricing errors, inventory inaccuracies, suspected fraud, or other legitimate business reasons.

If an order is canceled after payment has been processed, a refund will be issued to the original payment method.

5. Payment

Payments are securely processed through Shopify Payments and other payment methods made available through Shopify.

By providing payment information, you represent that you are authorized to use the selected payment method.

Vie Artlétique does not store complete payment card information.

6. Shipping

Shipping estimates provided on the Website are for informational purposes only and are not guaranteed.

Delivery times may vary due to weather, carrier delays, customs processing, or other circumstances beyond our control.

Risk of loss and title for purchased products transfer to you upon delivery to the shipping carrier or as otherwise required by applicable law.

7. Returns & Exchanges

Returns and exchanges are governed by our Return & Exchange Policy.

Unless otherwise stated, returned products must generally be:

• Unworn
• In their original condition
  
• Returned with original packaging
  
• Returned within the applicable return period
  

Certain items, including gift cards, customized products, and final sale merchandise, may not be eligible for return or exchange.

8. Intellectual Property

All content available on the Website—including trademarks, logos, product names, designs, graphics, photographs, videos, illustrations, text, software, and other materials—is owned by or licensed to Vie Artlétique and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website solely for personal, non-commercial shopping purposes.

If you submit reviews, photographs, testimonials, comments, or other content to Vie Artlétique, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, distribute, and display that content in connection with our business.

You represent that:

• You own or have permission to submit the content;
  
• The content does not infringe the rights of any third party;
  
• The content is not unlawful, misleading, defamatory, or offensive.
  

We reserve the right to remove content at our discretion.

11. Copyright Infringement Claims (DMCA)

We respect the intellectual property rights of others and expect users of the Website to do the same. Counter-Notification. If you believe material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated copyright agent containing: (i) your physical or electronic signature; (ii) identification of the material removed and its location before removal; (iii) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (iv) your name, address, telephone number, and email address, together with a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, the courts of Miami-Dade County, Florida), and that you will accept service of process from the person who filed the original notice. Repeat Infringers. We reserve the right to terminate the accounts of users who are determined to be repeat infringers.

From time to time, Vie Artlétique may offer promotional codes, discounts, giveaways, or limited-time offers.

Unless otherwise specified:

• Promotions cannot be combined;
  
• Promotions have no cash value;
  
• Promotions may not be transferred or resold;
  
• We reserve the right to modify or cancel promotions at any time.
  

14. Product Warranty

Vie Artlétique stands behind the quality of its products.

If you believe a product has a manufacturing defect, please contact our Customer Experience team.

Normal wear and tear, misuse, accidental damage, improper care, or use outside the intended purpose are not covered.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and all products and services are provided on an "as is" and "as available" basis.

Except as expressly stated, Vie Artlétique disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not allow certain warranty limitations, so portions of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Vie Artlétique shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the Website or purchase of our products. Nothing in this section limits liability where such limitation is prohibited by law

Our total liability for any claim relating to the Website or your purchase shall not exceed the amount you paid for the applicable product giving rise to the claim, except where prohibited by law.

IndemnificationYou agree to defend, indemnify, and hold harmless Vie Artlétique and its affiliates, officers, directors, employees, agents, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising out of your violation of these Terms or your misuse of the Website.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Website shall be resolved in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise.

19. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein (including our Shipping Policy, Return & Exchange Policy, and Warranty Policy), constitute the entire agreement between you and Vie Artlétique regarding your use of the Website, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the same subject matter.

21. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by an authorized representative of Vie Artlétique.

You may not assign or transfer these Terms, or any of your rights or obligations under these Terms, without our prior written consent. We may assign or transfer these Terms, in whole or in part, at any time and without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. These Terms will bind and benefit the parties and their respective successors and permitted assigns.

23. Force Majeure

We will not be liable for any failure or delay in performance under these Terms resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic or public health emergency, war, terrorism, riots, civil unrest, acts of government or civil authority, fire, flood, labor disputes, internet or telecommunications failures, or shortages of transportation, fuel, energy, labor, or materials.

By using the Website, creating an account, or placing an order, you consent to receive communications from us electronically, including by email, text message, or notices posted on the Website. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
